Mr. Duran obtained his Juris Doctorate from Nova Southeastern University, Shepard Broad Law Center. He has been a member of the Florida Bar since 1998. He is admitted to practice law in the U.S. Southern District and Bankruptcy Court of Florida. Immediately after law school, Mr. Duran founded the Law Office of Pelayo Duran, P.A., where he has successfully practiced law for over 16 years. In his extensive legal career, Mr. Duran has represented thousands of clients in obtaining a fresh start from their debt problems through a series of different legal methodologies like Chapter 7, 11 or 13 Bankruptcies, foreclosure defense, civil litigation, loan modifications, short sales, quiet title actions, refinancing and real estate closings. For over 16 years, his firm has also successfully represented thousands of clients in the areas of personal injury litigation, including: auto accidents, medical malpractice, slip and falls, premise liability, employment discrimination litigation (sex, age, race, religion, national origin, sexual orientation, sexual harassment) and retaliation under Title VII, Florida Civil Rights Act, Florida Whistle Blower’s Act and Worker’s Compensation under 440.205.
In 2007, Mr. Duran founded Fresh Start Real Estate LLC., where he currently is an equity partner and Licensed Real Estate Broker specializing in the areas of short sales and other complex and/or distressed real estate transactions and/or Broker Price Opinions (BPO).
Mr. Duran is now offering his extensive and uniquely broad practical knowledge as an approved U.S. Bankruptcy Court Mediator for the Mortgage Modification Mediation (MMM) program.
Ana C Augusto, Esquire:
Ms. Augusto graduated from the University of Miami, School of Law in 2004. She is admitted to practice law in the U.S. Southern, Middle and Northern Districts and Bankruptcy Courts of Florida.
Ms. Augusto has extensive practical knowledge of all the options available in order to liquidate or modify distressed properties since she has extensive practical knowledge in the processing of loan modifications and short sales through many Government and private assistance programs. For the last 6 years, she has primarily concentrated her legal practice in the areas of commercial and residential foreclosure litigation, personal and corporate bankruptcies, bankruptcy litigation, i.e. adversarial proceedings, lien stripping, Rule 2004 examinations, fraudulent transfers and avoidance actions.
Ms. Augusto also has an extensive practical experience in the areas of family law, including dissolutions of marriage, custody, visitations, domestic support obligations and other marital disputes. Ms. Augusto is now using her extensive legal practical experience and training as an approved U.S. Bankruptcy Court Mediator for the Mortgage Modification Mediation (MMM) program.
